Die LUG Wilhelmshaven hat versucht sich als Verein zu etablieren
und dabei ist unser Vorhaben vom Gericht mit folgender Begründung
abgelehnt worden:

Nach Rücksprache mit unserer Notarin teilte sie mir mit der Herr
Schumacher würde auf einer expliziten Freigabe des Namens "Linux"
bestehen. Das bereits ale anderen LUG Vereine diesen Namen nutzen
ist ihm scheinbar egal.
Ich hab das Problem bereits mit der FSF-Europa, dem LIVE und auch
mit Linus diskutiert. FFII, DELUG, werd ich heute noch anrufen.
So wie es aussieht ist unser Problem nur über ein offizielles Paper
zu regeln in dem der LUG-WHV explizit das Recht eingeräumt wird
den Namen Linux zu verwenden. Ich habe Linus bereits gebeten er
möge doch ein Paper schicken in dem für Deutchland jeder LUG diese
Recht eingeräumt wird, mal sehen wie Lange das dauert. [1]
Nach meinen bisherigen Informationsstand scheint unsere Ablehnung
ein Novum zu sein, welches aber bundesweite Auswirkungen haben
könnte. Nach den Buchstaben des Gesetzes ist das Vorgehen des
Herrn Schumacher scheinbar hieb und Stichfest. *grummel*
So wie mir Sabine Gold aus der Geschäftsstelle des LIVE erzählt hat
gibt es bereits einige Fälle in denen deutsche Unternehmen sich
Namen wie "Linux Park" haben eintragen lassen. Da es in
Deutschland niemenden gibt der die Rechte für Deutschland am Namen
Linux hält wäre es prinzipiell möglich Linux als Namen
registrieren zu lassen.
Ich denke man sollte sich hier eine gemeinsame Vorgehensweise /
Regelung überlegen um dieses grundsätzliche Problem für ein und
allemal aus dem Wege zu räumen. Entweder das z.B. die DELUG als
Verband sich die Nutzung Namens für seine Verbandsmitglieder
bestätigen lässt und die anderen Verbände dies genauso tun. oder
das eine Organisation wie der FSFde Verein oder die FSF Europa
sich diese Nutzung für alle in Deutschland, oder Europa bei der
FSF Europa.
Falls jemand hier bereits ähnliche Probleme hatte und eine Lösung
gefunden hat,.. her damit

Trademark Problems using LINUX for our club name

It seems that LINUX USER GROUP Wilhelmshaven Germany has need for
some help from the father of the movement himself. :)
Here in Germany it is a common procedure to establish a Linux User
Group as a let me call it "registered club acting in public
interest" By doing this we will get a better reputation and will
be able to benefit from public donations done by state
institutions and company subscriptions to finance our activities
(information work in the name of the penguin to public and
companies mostly). As we say in Germany, "If seven Germans will
come together the are founding a club" :)
_But_ here at the edge of our Republic, half a mile in front of the
shores of the german see, it seem that some worldwide common known
facts dont reach the authorities yet. Trying to establish LINUX
USER GROUP Wilhelmshaven as registered club we got the following
disaffirmation from Mr. Schumacher a local court representative.
My translation:
The club name contains the essential element "Linux" which is a
name of a common known Operation System. It has to be examined if
this is a registered name and if there has to be an adhesion of
the carrier of this name has to be presented.

As far as I beleve over the long run sooner or later we should be
able to resolve an issue in court. But as we say here, "There has
to be a big wedge for a big chunk of wood."
If you may send us an official statement as the owner of the
trademark/name "linux" that we are allowed to use the name Linux
as part LINUX USER GROUP Wilhelmshaven name this will be the right
wedge we are thinking about to suit this big chunk of wood the
court reresentative offered us. :))
May be, its just a idea ive got, you can give us a letter with will
give every Linux User Group in Germany the permission to use Linux
as part of their organisation/club name. I will forward it to
DELUG the german Linux User Group organisation.
Give me a note with your postal address when you need a copy of
the disaffirmation we received from Mr Schumacher.
BTW, Ive discussed our problem with Georg C. F. Greve, President
Free Software Foundation Europe some hours ago. He told me that
this Problem occurs time by time and is well known at FSF-Europe.
I believe he is still laughing about Mr. Schumacher. :)
